Terms of Service

These terms cover your use of CaptionCub (the "Service") at this website. CaptionCub is operated by Cloud Data Hosting LLC, a Minnesota company ("we", "us"). By signing in or using the Service you agree to these terms. If you don't agree, don't use the Service.

1. YouTube

CaptionCub uses YouTube API Services. By using CaptionCub you agree to be bound by the YouTube Terms of Service. How we handle your data is described in our Privacy Policy, and Google's handling of it in the Google Privacy Policy.

CaptionCub is an independent tool. It is not made, endorsed or sponsored by YouTube or Google.

2. Your account

You sign in with a Google account. You must meet the minimum age to use YouTube and Google services in your country.
You may only connect a YouTube channel you own or are authorized to manage, and only use CaptionCub with videos on that channel.
You're responsible for activity under your account. Tell us at admin@snugglesmp.com if you think someone else has used it.

3. Your content

You keep all rights to your videos, captions and other content. We claim no ownership.
You give us permission to store, process and transmit your content only as needed to run the Service for you: downloading or receiving your video, transcribing its audio, rendering subtitles, and sending results to YouTube when you ask.
You confirm you have the rights needed for the content you process, including any music, footage or speech in your videos.

4. Publishing to YouTube

CaptionCub only changes your YouTube channel when you press a publish or upload button. You're responsible for what you publish, including its accuracy, and for complying with YouTube's rules and Community Guidelines. Automatic transcriptions can contain mistakes, so review captions before publishing them.

5. Acceptable use

Don't use CaptionCub to:

process content you don't have the right to use, or that is illegal;
harass, defame or harm anyone, or publish content that violates YouTube's policies;
get around usage limits, access other people's projects or channels, or interfere with the Service or its servers;
scrape, resell or automate access to the Service without our permission.

We may limit, suspend or close accounts that break these terms or put the Service or other users at risk.

6. Availability and limits

The Service is provided free of charge and may have limits on project count, video length, storage time or daily YouTube uploads. Files may be removed after a period set by us (currently rendered videos after 14 days); see the Privacy Policy. We may change, pause or discontinue features at any time.

7. Ending your use

You can stop using CaptionCub at any time. Delete your account from your projects page to remove your data, and revoke CaptionCub's access to your Google account at Google Account permissions.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that transcriptions will be accurate, or that the Service will be uninterrupted, error-free or keep your files indefinitely. Keep your own copies of anything important.

9. Limitation of liability

To the fullest extent the law allows, Cloud Data Hosting LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, revenue, views or channel standing, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to US $50.

10. Changes

We may update these terms. If a change is significant we'll post a notice on the site before it takes effect. Continuing to use the Service after that means you accept the updated terms.

11. Governing law

These terms are governed by the laws of the State of Minnesota, USA, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Minnesota.
